These terms cover your use of MailWatchman, including the free domain check at check.mailwatchman.com and the paid monitoring plans (“the Service”). By using the Service you agree to them. If you don’t agree, please don’t use the Service.
What MailWatchman does
MailWatchman reads public DNS records for a domain (such as MX, SPF, DKIM and DMARC records) and checks public spam blacklists, then reports what it finds with explanations and suggested fixes. Paid plans repeat these checks automatically and email you when results change. MailWatchman never accesses your email account, mailboxes or messages.
Your account
You sign in with a single-use link sent to your email address. You’re responsible for keeping access to that email account secure, and for activity under your MailWatchman account. You must be at least 18 years old and able to enter into a binding agreement to subscribe.
Domains you monitor
The free check works on any domain, because it only reads publicly available information. For paid monitoring, add only domains you own or are authorized to manage. Don’t use the Service to harass others, to probe systems you aren’t authorized to test, or in a way that disrupts the Service or other users, including automated or high-volume use of the free check.
Plans, payment and taxes
Paid plans are billed monthly in advance and renew automatically until canceled. Prices are shown on our website and at checkout.
Purchases are processed by Stripe through its Managed Payments service, and Stripe (with its affiliate Link) is the merchant of record for your purchase. That means Stripe processes your payment, calculates and collects any applicable sales tax, VAT or GST, sends your receipts and invoices, and handles payment disputes. Stripe’s own terms and privacy policy, presented at checkout, apply to the payment transaction. MailWatchman never receives or stores your full card details.
Canceling, changing plans and refunds
You can cancel or change plans at any time from your dashboard under “Manage billing.” When you cancel, monitoring continues until the end of the period you’ve paid for and you won’t be charged again. Upgrades take effect immediately with a prorated charge; downgrades take effect at the end of the current period.
Payments for periods already started are generally not refundable, except where the law requires otherwise or where Stripe, as merchant of record, issues a refund under its policies (which may include refunds within 60 days of purchase in certain cases and cooling-off periods required in some regions). If something isn’t working for you, email us and we’ll do our best to make it right.
No guarantee of delivery
MailWatchman reports on how your domain’s public email records look at the time of each check. Email providers make their own filtering decisions using many signals we can’t see, so a good grade doesn’t guarantee your email will reach every inbox, and we can’t guarantee that every problem will be detected or that alerts will arrive at a particular time. Results and suggested fixes are general information, not professional advice; make DNS changes carefully, and consult your email provider or an IT professional if you’re unsure.
Availability and changes
We work to keep the Service running reliably, but it may occasionally be unavailable for maintenance or reasons outside our control. We may improve or change features over time. If we make a change that materially reduces what a paid plan includes, or change prices, we’ll email you in advance, and price changes apply from your next billing period.
Disclaimer and limitation of liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, MailWatchman won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not fully apply to you.
Ending your use
You can stop using the Service at any time. We may suspend or end access for accounts that break these terms or misuse the Service. If we end a paid account without cause, we’ll refund the unused portion of the current period.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Santa Clara County, California, unless the law where you live gives you the right to bring a claim elsewhere.
Changes to these terms
We may update these terms. We’ll post the new version here with a new effective date, and email paying customers about material changes before they take effect.
